Terms and Conditions of Sales

The General Terms and Conditions of Sales, detailed below, governs the relations between the TVPaint Developpement Company (hereinafter known as 'TVPaint'), with a capital of 50000€, headquarters being based at Maizieres-les-Metz, registered at the French Commerce Register under the number 413 299 074, and the user on the TVPaint's site (hereinafter known as 'user').

The General Terms and Conditions of Sales, detailed below, governs the contractual relations between TVPaint and the user. These General Terms and Conditions of Sales are the only applicable ones for every purchase on TVPaint's site.

Every purchase on the site is governed by the General Terms and Conditions of Sales applicable at the day of the purchase. TVPaint considers that, by confirming his order, the user accepts, without reserve, the General Terms and Conditions of Sales., after having read them.

These General Terms and Conditions of Sales replace all other conditions, excepted written dispensations by TVPaint.

TVPaint keeps the right to modify these General Terms and Conditions of Sales whenever it wants. In that case, the conditions will be the ones in operation at the date of the order.

Products and services offered are the ones presented in the catalogue published on the site of TVPaint.

These products and services are offered within the limits of the available stocks.

Each product comes with a short description.

Photos in the catalogue are as close as possible but can not assume a perfect similitude with the product, especially colors.

Prices in the catalogue are without VAT in euros and with VAT in euros when it is needed, using the current applicable VAT the day of the order. A new rate can be reflected on the prices of the products and services.

TVPaint keeps the right to modify its prices whenever it wants, considering the price in the catalogue the day of the order will be the only one applicable.

Indicated prices include processing fees of the orders, shipping charges, if the orders are processed in the geographical areas detailed below.

The online sales of products and services presented on this site concern every natural or corporate person whenever the order is processed. TVPaint keeps the right to refuse an order in function of its geographical location.

The use, who would like to buy products or services, must:

* Fill the identification form with all the information needed;
* Fill the online order with the references of the products and services asked;
* Confirm his order after verification;
* Pay in the intended conditions;
* Confirm his payment.

The confirmation of the order implies the user accepts, without reserve, these General Terms and Conditions of Sales.

All the given data and the registered confirmation will be considered as proof of the transaction. The confirmation will be considered as signature and acceptance for the processus.

TVPaint will communicate by e-mail the tracking number if it exits.

Due to several abuse (stolen credit cards, fraudulent use of paypal, etc ...) there is no possibility to cancel a purchase once the package is shippped.

Every training canceled less than 48h before the planned date have to be paid.

The price is payable at the time of order.

Payments will be done via the secure PayPal system which is using the SSL (Secure Socket Layer) Protocol. This encrypt all data sent by a software on the network so no one can know them.

The amount will be withdrawn on the user's account during the products shipment or available services. The amount will match with the products or services sent or downloaded.

In the geographical areas, subjugated by VAT, a paper invoice with VAT will be sent to the user.

Products are delivered at the address indicated on the order, in the geographical areas.

Risks are at the charge of the user as soon as the products have left the TVPaint office. In case of damage during the shipment, the motivated protest must be lodged to the carrier within 3-days delay from the receipt.

Shipment's delays are given as an indication.

Shipping Charges do not include Tax, Brokerage Surcharges, or Custom/Duty fees that may be required or allowed by the destination Country. Customers needing a Physical Shipment to any country WILL BE RESPONSIBLE for any VAT (15-25% of order value) and Broker Surcharges ($25-$30) which are charged by the carrier and payable at the time of delivery.

All products sold by TVPaint benefit of a legal warranty according to the French Clause 1641 and following of the Civil Code.

In case of non-conforming sold product, it can be returned to TVPaint which will take it back, exchange it or refund the user.

All complaints, exchange or refund requests, must be made by mail with acknowledgment at the following address: TVPaint Developpement - Route de Marange - 57280 Maizières-les-Metz - FRANCE within a 30-days delay from the receipt.

TVPaint has only a method duty for its online sales process and can not be involved for any damage due to the use of the Internet such as loss of data, intrusion, virus, break of service or others undesired problems.

All parts of TVPaint's site are and remain under the exclusive copyright of TVPaint, except opposite quote.

Nobody can duplicate, profit, diffuse or use in any way, even partially, parts of the site.

According to the French Law relative to computing, files and liberties of January 6th 1978, informations with registered securities relative to the user can be used in an automatic process.

TVPaint keeps the right to collect informations concerning the user by all ways and, if it wants to, transmit them to partner.

Users can oppose themselves to the divulgation of their personal informations by indicating it to TVPaint. In the same way, users have an access to their informations for rectification, according to the French Law of January 6th 1978.

TVPaint will file orders and invoices on a reliable and durable support representing a faithful copy according to the French Clause 1348 of the Civil Code.

The computerized registries of TVPaint will be considered by all parties as proof for communications, orders, payments and transaction between parties.

These General Terms and Conditions of Sales are subjected to the French Laws.

In case of disputation, competence is accredited to the capable tribunals of Metz.
